Abstract:
This articleexaminesthepotentialscopeoflegalprotectionsforcertain outworkers asaresultofrecentlyenactedfederallegislativeprovisions.The article beginswithanoverviewofexistinglegalprotectionsunderstateand territory lawsforindependentcontractoroutworkerslabouringinindustries outside thetextile,clothingandfootwearsector¿protectionswhich survived theHowardgovernment¿sfederaltakeoveroflabourlaw.The article thenexamineshowthefurthercentralisationoflabourlawunderthe Rudd Laborgovernmenthasaffectedtheseexistinglegalprotections.In particular,thearticleanalysestheimpactuponthesestatejurisdictionlegal protections fromtheWorkplaceRelationsAmendment(Transitionto Forward withFairness)Act2008(Cth)andtheFairWorkAct2009(Cth).
